Terms of Service

Please read these Terms of Service ("Terms") carefully before placing an order or using the services provided by EmbroideryDigitize ("we", "us", "our"). By accessing our website or purchasing a service you agree to be bound by these Terms. If you do not agree, do not use our services.

1. Services

EmbroideryDigitize provides professional embroidery digitizing, vector tracing, and related graphic conversion services. The scope, pricing, and turnaround time for each service are described on our Pricing page.

• —Turnaround times are estimates and begin once all required files and order details are received.
• —Rush orders may be available at an additional fee and are subject to capacity.
• —Final file formats are as listed in the service description unless otherwise agreed in writing.

2. Orders & Payment

• —Orders are accepted worldwide and must include sufficient artwork or source material for completion.
• —Payment is due at the time of order unless a pre-approved credit arrangement exists.
• —We accept payment via Stripe (credit/debit card). All transactions are processed in USD.
• —Prices are subject to change; the price at the time of order confirmation applies to that order.
• —By submitting payment you confirm you are authorised to use the payment method provided.

3. Revisions

We stand behind our work. Revisions are included for all orders:

• —Revisions must be requested within 7 days of delivery.
• —A revision covers adjustments to the original instructions. Changes to the design brief or artwork after work has started may incur additional charges.
• —Revisions do not apply where differences result from variations between on-screen previews and physical embroidery output, which is inherent to the medium.

4. Refunds & Cancellations

• —Once work has begun on an order, cancellations are not accepted and no refund will be issued.
• —If we are unable to complete an order we will issue a full refund.
• —Refunds for quality issues are evaluated case-by-case after a revision opportunity has been provided and the issue remains unresolved.
• —Digital files are non-refundable once downloaded.

5. Intellectual Property & File Ownership

You retain ownership of all source artwork and designs you submit. By submitting artwork you represent that you have the right to use it and grant us a limited licence to process it for the purpose of fulfilling your order.

Upon full payment, digital work product (e.g., digitized stitch files) is licensed to you for your own commercial and personal embroidery use. We retain the right to display completed work in our portfolio unless you request otherwise in writing at the time of order.

We will not reproduce, resell, or distribute your submitted artwork or completed files to third parties without your permission.

6. Acceptable Use

You agree not to:

• —Submit artwork that infringes third-party intellectual property rights, trade marks, or copyrights.
• —Submit content that is unlawful, harassing, defamatory, obscene, or otherwise objectionable.
• —Attempt to reverse-engineer, scrape, or interfere with our platform or services.
• —Use our services for any illegal purpose.

We reserve the right to refuse or cancel any order that we believe violates these guidelines, without obligation to explain our reasoning.

7. Accounts

• —You are responsible for maintaining the confidentiality of your account credentials.
• —You are responsible for all activity that occurs under your account.
• —Notify us immediately at support@embroiderydigitize.com if you suspect unauthorised access.
• —We reserve the right to suspend or terminate accounts that violate these Terms.

8. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to implied warranties of merchantability or fitness for a particular purpose. We do not warrant that the service will be uninterrupted or error-free.

9. Limitation of Liability

To the fullest extent permitted by applicable law, EmbroideryDigitize shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with these Terms or the use of our services, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from or related to these Terms or our services shall not exceed the amount you paid us in the 90 days preceding the claim.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes shall first be attempted to be resolved amicably. If unresolved, disputes shall be subject to binding arbitration or the courts of the jurisdiction in which EmbroideryDigitize operates.

11. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms with an updated date. Material changes will be communicated to registered users by email. Continued use of our services after changes constitutes acceptance of the updated Terms.
